MINUTES OF SPECIAL BOARD MEETING

Chairman McDowell called the special meeting to order at 9:30 a.m. The roll was then taken. Directors Pozzi, Olufs, Doherty and Chairman McDowell were all present. Director Nelson was absent. Battalion Chief/Fire Marshal Matt Gustafson, Battalion Chief Joe Giordani and the District’s legal counsel, Mr. William Arnone, were also in attendance. The Chairman asked Mr. Arnone to serve as acting secretary for the meeting. There were no changes to the Agenda. Following the Pledge of Allegiance, the Chairman called for public appearances, but there were none. The Chairman then asked Mr. Arnone to announce the adjournment into close session. At 9:32 a.m. Mr. Arnone announced that the Board would adjourn to a closed session to discuss one item in accordance with Government Code Section 54957, regarding Public Employee Discipline/Dismissal/Release, whereupon the Board did so adjourn. The Board, thereafter, deliberated in closed session until 10:35 a.m., when it reconvened the opened session portion of the meeting. At that time, Mr. Arnone announced that, during the closed session, the Board took the following action: upon a motion made by Director Doherty, that was seconded by Director McDowell and unanimously approved, the Board upheld the decision of Battalion Chief/Fire Marshall Gustafson to terminate the employment of the grievant. There being no further business, at 10:36 a.m., Director Doherty made a motion to adjourn which was seconded by Director Pozzi and unanimously approved, whereupon the meeting was adjourned at 10:36 a.m.
